These Terms & Conditions govern your use of The Flux Review website and any services purchased, commissioned or arranged through The Flux Review.

By using this website, submitting material to us, booking a service or making a payment, you agree to these Terms & Conditions.

1. About The Flux Review

The Flux Review is an independent arts and culture publication providing editorial content, artist interviews, features, critical reviews, profiles and related promotional and publishing services.

References in these Terms & Conditions to “The Flux Review”, “we”, “us” or “our” refer to The Flux Review and its operators.

2. Website Use

The content of this website is provided for general information and editorial purposes.

While we take reasonable care to ensure that information published on the website is accurate, we cannot guarantee that all information will always be complete, accurate or current.

We may update, amend, remove or replace website content at any time without notice.

You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation or use its content for unlawful purposes.

3. Editorial Services

The Flux Review offers a range of editorial and promotional services, which may include:

  • artist interviews and Q&As;

  • printed magazine features;

  • online features and profiles;

  • critical reviews and critical writing;

  • artist gallery and profile pages;

  • guest articles;

  • advertising and promotional features; and

  • other editorial or publishing services agreed with us.

The exact scope of a service will be set out on the relevant website page, invoice, email correspondence or other written agreement.

Payment confirms the booking of the service described. It does not give the client control over The Flux Review’s independent editorial judgement.

4. Editorial Independence

The Flux Review retains editorial control over material published under its name.

We may edit submitted material for spelling, grammar, clarity, length, formatting and house style.

Where a service involves independent critical or editorial writing, the writer’s assessment and interpretation will remain independent.

Payment for a review, interview, feature or other service does not entitle the client to dictate the conclusions, opinions or critical assessment contained within independent editorial content.

We reserve the right to refuse material that we consider unlawful, defamatory, discriminatory, misleading, offensive, infringing or otherwise unsuitable for publication.

5. Critical Reviews

Critical reviews are written as independent editorial assessments of an artist’s work based upon the artwork, information and supporting material supplied to us.

Where a client commissions a review for professional development, funding, immigration, Global Talent or other evidential purposes, The Flux Review does not guarantee that the review will satisfy the requirements of any particular organisation, government body, funding body, endorsing body or application process.

It is the client’s responsibility to determine whether a particular publication, review or service is suitable for the purpose for which they intend to use it.

We do not provide immigration, legal or regulatory advice.

6. Interviews and Q&As

Artists and contributors participating in interviews or Q&As are responsible for the accuracy of the information they provide.

The Flux Review may make reasonable editorial amendments for grammar, spelling, readability, formatting and house style while seeking to preserve the contributor’s intended meaning.

Submission of completed interview answers and accompanying images constitutes permission for us to edit and publish those materials as part of the agreed feature.

7. Magazine Features

Bookings for printed magazine features relate to the number of pages or other format agreed at the time of booking.

The final design, layout, typography, image positioning and editorial presentation remain at the discretion of The Flux Review unless otherwise agreed in writing.

Artists may be asked to supply suitable high-resolution images and supporting information by a specified deadline.

Failure to provide material by the requested deadline may result in the feature being postponed, reduced, adapted or omitted where publication schedules make inclusion impossible.

Publication dates are given in good faith but may occasionally change due to editorial, production, printing or distribution requirements.

8. Magazine Delivery

Delivery times for printed copies of The Flux Review will vary depending on the destination country.

For UK deliveries, please allow up to 7 working days from dispatch.

International deliveries may take longer depending on the destination, local postal services, customs procedures and other factors outside our control. Any estimated international delivery times are provided as a guide only and are not guaranteed.

The Flux Review cannot be held responsible for delays caused by postal services, courier services, customs processing or other circumstances outside our reasonable control.

If your copy of The Flux Review arrives damaged, please contact us as soon as possible and provide clear photographs of the damaged magazine and packaging, together with your order details and any relevant information regarding the damage.

Once we have reviewed the information provided, we will determine the appropriate resolution, which may include arranging a replacement copy where appropriate.

If an incorrect or incomplete delivery address has been supplied by the customer, we cannot guarantee replacement or redelivery without an additional postage charge.

9. Images and Copyright

Artists and contributors retain copyright in their original artwork and photographs unless otherwise agreed.

By supplying images or other material to The Flux Review for publication, you grant us a non-exclusive licence to reproduce, crop, resize and display those materials where reasonably required in connection with:

  • the agreed article, interview, review or feature;

  • The Flux Review website;

  • printed and digital editions of The Flux Review;

  • The Flux Review’s social media channels;

  • newsletters; and

  • promotion of the relevant feature, publication or The Flux Review.

This licence does not transfer ownership of your copyright to The Flux Review.

You confirm that you own the material supplied or have obtained all necessary permissions for us to publish it.

Where a photographer, gallery, agency or other third party requires a credit, you are responsible for providing the correct credit information when submitting the image.

You agree to indemnify The Flux Review against reasonable claims arising from material you supplied where you did not have the necessary rights or permissions to authorise its publication.

10. Copyright in The Flux Review Content

Unless otherwise stated, the editorial content, written reviews, interviews, graphic design, layouts, branding and other original material produced by The Flux Review are protected by copyright.

Content may not be reproduced, republished or commercially exploited without permission, except where permitted by law.

Artists may share links to their published features and reasonable extracts or images of their coverage for personal portfolio and promotional purposes, provided The Flux Review is appropriately credited.

11. Submissions

Submission of artwork or other material does not guarantee acceptance or publication unless a booking has subsequently been confirmed.

We reserve the right to accept or decline submissions according to our editorial judgement.

Unless specifically agreed otherwise, materials submitted to us may be retained for reasonable editorial and administrative purposes.

12. Fees and Payment

Prices will be those quoted on our website, invoice or correspondence at the time of booking.

Unless otherwise agreed, payment is required before editorial work begins or publication space is confirmed.

Where VAT or other applicable taxes are payable, this will be indicated where relevant.

Any additional work outside the agreed service may be subject to an additional charge, which will be agreed before that work is undertaken.

13. Cancellations and Refunds

Cancellation rights depend upon the type of service purchased and whether work has begun.

Where a customer is legally entitled to a statutory cancellation period, those statutory rights are unaffected by these Terms & Conditions.

If you ask us to begin providing a service during an applicable statutory cancellation period, you may be required to pay for work already completed if you subsequently cancel, to the extent permitted by law.

Once bespoke editorial work has been completed, or publication and production work has progressed substantially, refunds may not be available except where required by law.

For printed magazine space, once pages have entered design, production or printing, cancellation or transfer to a future edition is at the discretion of The Flux Review.

Nothing in these Terms & Conditions limits any cancellation, refund or other rights that you are entitled to under applicable consumer law.

14. Corrections and Amendments

We want published information to be accurate.

If a factual error is identified in online editorial content, please contact us and we will consider an appropriate correction.

Requests to substantially rewrite published independent criticism, alter an author’s opinion or change editorial conclusions will not normally be accepted simply because the subject disagrees with the assessment.

Additional amendments requested after agreed work has been completed may be chargeable where they go beyond reasonable factual corrections.

15. Publication and Availability

We make reasonable efforts to maintain online articles and features, but we cannot guarantee that any particular webpage or digital feature will remain available indefinitely.

Websites, URLs, formats and publication platforms may change over time.

Printed editions are subject to availability and normal printing and distribution limitations.

16. Third-Party Websites

The Flux Review may contain links to artists, galleries, organisations, products, services or other third-party websites.

We are not responsible for the content, security, availability or privacy practices of third-party websites.

A link does not necessarily constitute an endorsement unless expressly stated.

17. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

Subject to those rights, The Flux Review will not be responsible for indirect or consequential losses arising from use of the website or editorial services where such losses could not reasonably have been anticipated.

We are not responsible for decisions made by third parties based upon material published by The Flux Review, including decisions relating to funding, awards, competitions, exhibitions, representation, employment or immigration applications.

18. Events and Exhibitions

The Flux Review may occasionally promote or provide information about exhibitions, events or opportunities operated by The Flux Review, FLUX Exhibition or third parties.

Where separate terms apply to a particular exhibition, event or opportunity, those specific terms will take precedence in relation to that activity.

19. Privacy and Personal Information

Personal information collected through the website, submissions, bookings, mailing lists or correspondence will be handled in accordance with our Privacy Policy and applicable UK data protection law.

Our Privacy Policy should be read alongside these Terms & Conditions.

20. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, website, business practices or legal obligations.

The version displayed on this website at the time a service is booked will normally apply to that booking unless otherwise agreed or required by law.

21. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory rights you have under the laws applicable to you and nothing in these Terms & Conditions removes those rights.
